فلسطين هي الدولة الوحيدة في الشرق الأوسط التي ليس لديها تشريعات فعالة وحديثة تحمي حقوق الملكية الفكرية. ومع ذلك، هناك قوانين متفرقة مطبقة في فلسطين، مثل قانون البريطاني 1911 المعدل في سنة1924 المتعلق بقانون حق المؤلف والقانون الأردني للعلامات التجارية 1952 قانون امتياز البراءات والرسوم لسنة 1953. وفي عام 1995. صادقت السلطة التشريعية الفلسطينية على بعض التشريعات في مجال القانون الخاص، ولكن دون تضمينه تشريعات للملكية الفكرية. إن مصطلح الملكية الفكرية ليس شائعا بين المشرعين الفلسطينيين، أيضا هناك يوجد عدم وعي كبير بين أطياف المجتمع الفلسطيني بمفهوم الملكية الفكرية. تهدف هذه الدراسة إلى تسليط الضوء على قانون براءة الاختراع من خلال دراسة مقارنة ما بين القانون الفلسطيني والأردني لتكون قاعدة أساسية ومرجع في حال قيام المشرع الفلسطيني بتعديل قانون براءة الاختراع المطبق في الأراضي الفلسطينية

Palestine is theonly country in theMiddle Eastdoes not havelegislations which protecting the intellectual property rights.Note however that there aresporadiclaws appliedin Palestine, asthe Ottomanin1910related tocopyright law and theJordanian trademark and patent lawin 1953. In 1995the PalestinianAuthority has approvedsome legislationinthe field of privatelaw, such ascivil and commercial law, but without priority to the intellectualproperty legislation.Indeed, the term of intellectual propertyis not popularamong Palestinianlegislators;add there are a few expertsin this field. The purpose of this study is to make an objective comparison between the patentable subject matter in Palestine and Jordanian law in order to extract the similarities and differences to establish basic principles for new Palestinian Law. The Jordanian law is selected as it in general the law that applied in Palestine.
