بعد هجمات الحادي عشر من سبتمبر 2001 ضد برجي التجارة العالمية بدأت الولايات المتحدة الأمريكية اللجوء إلى استخدام الطائرات بدون طيار لملاحقة بعض الإرهابيين حول العالم وتحديداً ضد منظمة القاعدة الموجودة في باكستان، أفغانستان، اليمن والصومال. لكن لجوء الولايات المتحدة وبعض الدول الأخرى إلى استخدام مثل تلك الأسلحة المتطورة أثار جدلاً قانونياً حول مشروعية استخدامها. فبعض الكتاب لم يتردد بالقول إن القانون الدولي المعاصر ترك الباب مفتوحاً بحرية لاستخدام مثل تلك الأسلحة حيث إنه لم يرد أي نص صريح في القانون الدولي يمنع مثل تلك الأسلحة. لذلك فإن الغرض من هذا البحث القانوني هو التعرف على موقف القانون الدولي العام بفروعه المختلفة سواء القانون الدولي لحقوق الإنسان أو القانون الدولي الإنساني وكذلك القانون الجنائي الدولي. ففي هذا البحث الكثير من الأسئلة التي سوف تكون محط اهتمامنا. محورها : هل ميثاق الأمم المتحدة اتخذ موقفاً ما من هذة الاسلحة ؟ وهل عدم وجود اتفاقيات دولية تحظر استخدام الطائرات بدون طيار يعني إباحة استخدامها ؟ وهل يحق للولايات المتحدة أو دول أخرى تملك مثل تلك المنظومة من الأسلحة أن تلجأ للدفاع الشرعي ضد بعض الإرهابين المختبئين في دول اخرى بحجة تهديد هؤلاء للأمن القومي الأمريكي أو بحجة عدم مقدرة الدول التي يختبئ بها هؤلاء على وضع حد لتهديداتهم ؟ وهل قانون النزاعات المسلحة ينطبق على تلك الطائرات أو لا ؟

After the terrorist attacks of September 11, 2001, the UnitedStates of America began to use Drones against some terroristtargets of al-Qaeda, especially those positioned in Pakistan,Afghanistan, Yemen and Somalia, and they have become anexcellent weapon in fighting terrorism. However, the controversialuse of Drones by USA and other international forces raises legalquestions among international law scholars regarding the legality ofsuch military system. While some arguments support the legality ofthe use of Drones on the basis that public international law doesnot, explicitly or implicitly, prohibit such weapons, others disagree.This research paper will determine the position of publicinternational law, with its different branches, such as, internationalhumanitarian law, international human rights law and internationalcriminal law; from this issue. It will deal with questions relating tothe stand of the United Nations Charter from this kind of weapons,if there is any, and whether any potential absence of legal rulesregulating the use of such weapons could be interpreted as animplicit authorization of their use. In process of discussing thisissue, this research paper will focus on the legal perspective ofDrones In the light of Public International Lawpublic international law, which excludes all political aspects thatmight relate to the subject.
