Was Qatada (Qatada Bin Di`ama Al-Sadussi; a famous Jurist from Al-Basra 60117-Hijri.See number 4 of the footnotes of this research), the scholar who combined «Qadaria» inhis interpretation (ta’weel) (paragraphs412-), and «Salafia» in his jurisprudence (fiqh)doctrines (14), forgotten? He was famous for a long period of time in Al- Basra and hisfame reached Al-Kufa, Damascus and Al-Madina (3). He was famous for a long periodof time in Al- Basra and his fame reached Al-Kufa, Damascus and Al-Madina (3) he wasone of the prominent scholars during the reign of the of the Kalifat Hisham Bin Abd Al-Malik, However, after that, the flame of glory of Al-Basra’s jurisprudence started to fadeaway. What could possibly be the causes of this decline? Was it The Orthodox mind inthe way of mixing and matching in the methodological Jurisprudential trend? (13) Or wasit a clear manifestation of the marginalization and elimination (14) in the Islamic trends,as expressed by Mohammad Arkoun? The research of Josef Van Ess alludes to certainHypothesis or probabilities without revelation! May be he preferred to keep this for a futurework (12).Despite his fame; Qatada was not unique among Al Basra scholars. He was soonforgotten and his «Aqwal» were almost obsolete. However, this scholar, who had closerelations with Omayyad rulers (14), challenged forgetfulness and we got his «Aqwal» thanksto The opponents of the Omayyad, who witnessed torture and eviction: the «Ibadhiyyas».They have lived with Qatada in Al Basra, and some of them were his disciples (9).The «Ibadhiyyas» adopted his doctrines and included them in their Jurisprudentialtheory. Thus, they ensured his perpetuity (13). Was this gratitude to the ideological sources,or was it some kind of moderate jurisprudential thinking in the era of classical knowledge?(8, 9, 10, 12) In our present time though, why did most researchers adhere to conspiraciesof forgetfulness and all their approaches were simply descriptive, without any efforts tofind out the reasons behind the phenomena of marginalization and exclusion?(12) Is itbecause knowledge tools were disabled? Or is it the influence of jurisprudential schoolswhich prevailed? The most fair –minded of these barely devoted specified a few lines thejurisprudence of Al-Basra blaming it on the scarcity of news. What remains of Qatada, then? Just a little, yet precious; the «Aqwal» manuscriptas an example (14). Despite its heterogeneous quality which might as well be a sign ofits uniqueness (711-) , which is probably the main feature of its validity (from 7 to11)nothing could come close to it in value, but the first «Ibadi Imam»; Jaber Bin Zeid letters;both texts are among the oldest extant texts of what we got from the heritage of the IslamicFiqh (15). They are of great significance for the researcher.
